Avvocato Tributarista – Patrocinante in Cassazione

Gianluca, si occupa di assistenza in verifiche fiscali e contenzioso tributario da oltre 20 anni. In tale ambito ha affrontato in prima persona e con successo in tutti i gradi di giudizio compresa la Corte di Cassazione un’ampia casistica di contestazioni, acquisendo una profonda conoscenza delle più complesse problematiche fiscali.

Si occupa inoltre della risoluzione di specifiche e rilevanti questioni tributarie relative ad operazioni di M&A, alla tutela e trasferimento di patrimoni e di imprese familiari, alla fiscalità dei fondi immobiliari, dei settori REAL ESTATE ed energy, nonché delle imprese della GDO e del settore degli ascensori cui presta da oltre 20 anni assistenza continuativa, straordinaria e di contenzioso tributario.

Negli ultimi anni, Gianluca si è altresì occupato di due diligence fiscali relative all’acquisto di crediti d’imposta sia derivanti da lavori edili (Superbonus – Sismabonus – Ecobonus – Bonus Facciate etc.) sia relativi a crediti di imposta (IVA, IRES, ed IRAP) di proprietà di imprese sottoposte a procedure concorsuale o in bonis, ed assiste in via continuativa e in ambito di contenzioso tributario una banca commerciale leader del mercato dell’acquisizione dei crediti di imposta.

Gianluca, è’ inoltre autore di molteplici articoli pubblicati su riviste scientifiche e relatore a convegni relativi a varie tematiche tributarie organizzati anche da AIFI, ANDAF (Associazione Nazionale del Direttori Amministrativi e Finanziari) e dalla Camera di Commercio Italo Tedesca.

E’ stato Docente del Master di diritto tributario annuale organizzato da IPSOA – WKI – modulo del contenzioso tributario dal 2011 sino al 2018 nonché membro del Gruppo di lavoro “verifiche fiscali e best practice” dell’AIFI (Associazione Italiana del Private Equity Venture Capital Private Debt).

Ha conseguito la Laurea in Giurisprudenza nel 1997. Nel 2000 ha frequentato il Master annuale di specializzazione in Diritto Tributario presso la LUISS e nel 2008 il corso di specializzazione EC Direct Corporate Taxation presso IBFD International Tax Academy – Amsterdam The Netherlands. E’ iscritto all’albo degli avvocati dal 2001 ed all’albo speciale degli avvocati cassazionisti dal 2013.

Gianluca, has provided consultancy services in tax audits and tax litigation for over 20 years. In this context, he has personally and successfully challenged a wide range of claims before all levels of the Italian courts, including the Court of Cassation, acquiring in-depth knowledge of the most complex tax issues.

He also focuses on resolving specific and relevant tax issues relating to M&A transactions, the transfer of assets and family business, the taxation of real estate funds, the REAL ESTATE and energy sectors, as well as large-scale retail companies and the lift sector, for which he has provided continuous consultancy  (also in extraordinary matters) and tax litigation support for over 20 years.

In the last few years, Gianluca has also focused on tax due diligence relating to the purchase of tax credits deriving from Superbonus – Sismabonus – Ecobonus – Bonus Facciate etc. and tax credits (VAT, IRES, and IRAP) owned by companies subject to insolvency proceedings or in good standing, and advises on an ongoing basis and in the field of tax litigation a leading commercial Italian bank in the tax credit acquisition market.

Gianluca is also the author of numerous academic articles and a lecturer at conferences on various tax issues organised by AIFI, ANDAF (National Association of Administrative and Financial Directors) and the Italian-German Chamber of Commerce too.

From 2011 to 2018 he was a teacher of the tax litigation module of the annual Master’s degree in tax law organised by IPSOA – WKI, as well as a member of the ‘tax audits and best practice’ working group of AIFI (Italian Private Equity, Venture Capital and Private Debt Association).

He obtained his law degree in 1997. In 2000 he attended the one-year Master’s degree specialising in Tax Law at LUISS and in 2008 the EC Direct Corporate Taxation course at IBFD International Tax Academy – Amsterdam (The Netherlands). He has been a member of the Bar Association since 2001 and of the Italian Supreme Court Bar since 2013.
